20万码农叫板“996工作制”！京东、阿里巴巴等互联网大佬中枪

这几天，码农们搞了个大新闻。

3月27日，在程序员圈子里颇有名气的代码托管平台GitHub上，有人发起了一个名为“996.ICU”的项目，并迅速传开。

A programmer shared a project “996.ICU” on github.com, a well-known code-sharing website.

码农行事风格简单直接，上来先解释“996”工作制，和国内目前规定的一天8小时和一周最高不应超过48小时的标准相去甚远：

“996. ICU” refers to employees, mostly programmers from internet companies, who have to work from 9 am to 9 pm six days a week, whose health suffers as a result, and who end up in an intensive care unit.

996就是大家熟知的那个从早九点干到晚九点、一周六天的工作制，ICU则是特护病房。

他们的口号是：

工作996，生病ICU。

Follow the 996 schedule, and you end up in ICU.

截至发稿前，该项目获得的星数即将突破20万关口，这表示大约有20万名程序员关注了这个项目。

有人称996ICU为“GitHub星数上升最快的项目”，在舆论声中，大家开始将这个项目定义为“程序员的一次反抗”。发起人意在揭露互联网公司过度加班的证据。

此项目为开放型，网友注册后即可添加自己公司的加班情况，并附上证据。截至发稿，已经被举报过的公司有：华为、阿里巴巴、蚂蚁金服、京东、58同城等等等等，不下40家。

可以这么说，你每天在新闻上看到的那些互联网大公司，基本都榜上有名。

看到这么多互联网企业上榜，双语君（微信ID：Chinadaily_Mobile）并没有吃惊的感觉，因为超时加班在互联网行业早已不是秘密。

But that’s not a surprise because extra hours have never been a secret in internet companies.

有赞CEO白鸦就曾力挺996，怒怼众网友：

飞象网的项立刚则与国际接轨，指出这是全世界IT业界的文化：

哪怕是大家敬爱的马云老师，也说过“要讲工作和生活的平衡，那不可能！”

至少目前，还没听说过哪位互联网大佬表态过员工应该到点下班。无休止的加班，被认为是互联网行业的狼性文化，一度受到推崇。

就在前几天，京东还爆出内部信，要淘汰三种人：不能拼搏的人，绩效差的人，性价比低的人。虽然京东回应称爆料者脱离了上下文和具体语境，但并没有提供出上下文是什么。

那么996工作制究竟对不对呢？

强迫员工996，确定一定以及肯定违法。

双语君（微信ID：Chinadaily_Mobile）咨询了益仟律师事务所的崔振东律师，他表示，我国《劳动法》明文规定：

第三十六条【国家工时制度】国家实行劳动者每日工作时间不超过八小时、平均每周工作时间不超过四十四小时的工时制度。

The State shall practise a working hour system under which laborers shall work for no more than eight hours a day and no more than 44 hours a week on the average.

第四十一条 【工作时间延长限制】用人单位由于生产经营需要，经与工会和劳动者协商后可以延长工作时间，一般每日不得超过一小时;因特殊原因需要延长工作时间的，在保障劳动者身体健康的条件下延长工作时间每日不得超过三小时，但是每月不得超过三十六小时。

The employing unit may extend working hours due to the requirements of its production or business after consultation with the trade union and laborers, but the extended working hour for a day shall generally not exceed one hour; if such extension is called for due to special reasons, the extended hours shall not exceed three hours a day under the condition that the health of laborers is guaranteed. However, the total extension in a month shall not exceed thirty six hours.

《劳动法》护体

依照法律，996作为一种工作制度可是严重违法。

如果员工自愿加班且企业按法律标准支付加班费，在法律上倒是说得过去，但“被自愿”的事情，相信大家都听说过。

It is safe to conclude that compulsory 996 working schedule is illegal. It would be legal if an employee works extra hours on his or her own volition, but as the weaker side, they often find it very hard to say “no” to the boss.

在966.ICU项目的最下方，发起人也算了一笔账：“按照劳动法规定，996工作制下只有拿到当前工资的 2.275 倍，才在经济账上不吃亏。”

面对这种违法行为，码农们要如何应对？

当然可以去法院起诉，但光搜集证据、请律师就是一大笔支出，最后的赔偿金可能也就几个月工资，有那精力都不如多加几天班划算。

In order to put a stop to the practice, employees must collect evidence, hire a lawyer, and go through very long procedures to take their employers to court. And after paying for the legal battle, all the employee will receive is compensation equal to a few months' wages.

而且一旦走上法庭，就意味着与公司彻底撕破脸，需要另谋高就。

即使前东家厚道，没有给员工拉个黑名单，面对大部分互联网公司都要求加班的现实，这位码农也很难找到按时下班的公司。

Worse, the over 40 companies cover almost the entire internet industry. So that even if an employee wants to change company, it is highly likely that his new employer will also demand he or she work a 996 schedule.

再退一步，即使有老板善心大发，让员工五点半准时下班，那这位老板很可能会在竞争中处于不利地位，因为太多的互联网公司都在超额剥削员工。

Even if a company introduces a working schedule that allows employees to go home early, it might fall behind its competitors because it gets lower profit from employees. 

互联网是个更新换代很快的行业，长此以往，这家公司倒闭是大概率事件。

很有可能，倒闭了之后，这家公司还会被写进商学院教科书里：不能对员工太仁慈。

所以，真正可怕的，不是一家公司实行996，更不是几位大佬提倡996，而是整个行业都在996，让劳动者没有任何选择，也没有任何逃离的可能性。

当超时加班成为一种文化，这个行业的明天在哪里？超时加班，又只是互联网一个行业吗？
