Beware! Doing These Will Now Land You in Jail

As soon as we entered March this year, that is from March 1, eleventh amendment of the criminal law of the People's Republic of China came into force. 


In total, 25 new charges were added as criminal offenses, including: slandering of martyrs, throwing objects from height, impersonation, assaulting police officers, etc.


Below we have translated all of them for reference purposes only, most of them are self-explanatory and relates to some events. For example number 1~


1. Disrupting safe driving



This is related to a case when a physical altercation between a woman and a bus driver caused a bus carrying 15 people to plunge into a river in southwestern China on Oct. 28, 2018. 


The surveillance video from inside the bus showed the woman, 48, arguing with the bus driver for refusing to pull over after she missed her stop. 


The driver, 42, was seen gesticulating and turning his head toward her during the argument. The woman then hit the driver’s head with her cellphone. He took his right arm off the steering wheel and hit her back. When she tried to hit him again, he grabbed her arm and appeared to lose control of the bus.


Since then, China implemented several measures to ensure the safety of passengers in public transport. This law will serve to further enforce those measures.

Explanation: Refers to the violation of relevant safety management regulations in production and work environment


4. Producing, selling or supplying fake drugs



5. Producing, selling or supplying substandard drugs


6. Obstructing drug management

8. Helping overseas organizations to steal, spy, bribe, or illegally providing commercial secrets.


Just as his plan was getting well, he was about to send someone abroad for a regular meeting with his "supporters" when he was arrested by state security. In August 2020, Zhengzhou intermediate people's court of Henan Province sentenced Mr. Zhang to 13 years imprisonment for collusion with foreign spy agencies and forming illegal "party association."

9. Sexually assaulting someone under your care

12. Throwing objects at height


The first person to be convicted of this offense on the same day it came into effect is Mr. Xu from Liyang, Changzhou, Jiangsu Province. He was sentenced to six months in jail and fined 2,000 RMB.

13. Collecting illegal debts

14. Insulting the national flag, national emblem and national anthem


15. Slandering the reputation and honor of heroes and martyrs


Six people have been detained after police confirmed that they posted slandering statements about soldiers who died during a border clash last june. Apart from these six, police are pursuing another netizen who is now abroad for the same offense.

25. Dereliction of duty in food and drug supervision


These regulations came into effect on March 1, 2021.
