Basic requirements for employers

用人单位基本条件

1. Employers shall be established by law with actual business premises, pay taxes and social insurances according to law, without serious illegal and dishonest acts; the employment of foreigners shall be for special needs and the appropriate candidates are in short supply domestically in China; the salary or remuneration for those foreigners shall not no lower than the local minimum wage.

依法设立，无严重违法失信记录；聘用外国人从事的岗位应是有特殊需要，国内暂缺适当人选，且不违反国家有关规定的岗位；支付所聘用外国人的工资、薪金不得低于当地最低工资标准。

2. For pre-approval by the industry competent authority by law, it shall be approved.

法律法规规定应由行业主管部门前置审批的，需经过批准。

Basic requirements for applicants

申请人基本条件

1. Capable applicants with qualified professional skills or knowledge shall have a certain clearly defined employer in China and shall be at least 18 years old in good health and without a criminal record.

应年满18周岁，身体健康，无犯罪记录，境内有确定的用人单位，具有从事其工作所必需的专业技能或相适应的知识水平。

2. Those applicants must engage in urgently needed jobs in China and can make contributions to China’s economic and social development.

所从事的工作符合我国经济社会发展需要，为国内急需紧缺的专业人员。

3. The laws and regulations which have special provisions, if any, for the employment of foreigners in China shall prevail.

法律法规对外国人来华工作另有规定的，从其规定。

• The highest degree (academic qualification) certificate and certification documents

• Certificate of physical examination

• Employment contract or employment certificate (including the dispatch letter of a multinational corporation)

  聘用合同或任职证明（包括跨国公司派遣函）

• Passport or international travel certificate

  申请人护照或国际旅行证件

• Applicant’s bareheaded and full-face photo taken no more than six months ago

  申请人6个月内正面免冠照片

• Applicant’s valid Z visa, R visa or residence permit

  申请人所持签证（Z字或R字）或有效居留许可

Examination and Approval Period

办理流程

Preliminarily review online: applicant shall submit the application online for preliminarily review within 5 working days (the date of submissionis not included in the period). If the documents are incomplete and the contentis not standardized, the documents need to be supplemented and corrected online; if the documents are complete and the content is standardized, the documents shall be submitted online or by telephone appointment.

网上初审：申请人网上提交申请材料，5个工作日（材料提交当日不计算在期间内）内对网上提交的材料进行预审。材料不齐全、内容不规范的，在线告知需补正材料；材料齐全、内容规范的，在线告知或电话预约现场提交材料。

Reception at the window: If the application documents are complete and meet the requirements, it shall be accepted on the spot and the reception order shall be given.

窗口受理：对纸质材料审核后决定是否受理。申请材料齐全、符合要求的，当场予以受理并给予《外国人来华工作许可受理单》。

Review period: whether the application documents meet the requirements, whether the employing unit and the applicant have bad credit records, whether the application documents are true, complete and meet the requirements, and those who are complete and meet the requirements shall be reviewed and approved, and submitted to the municipal Bureau for decision.

审查：对申请材料是否符合规定，聘请单位及申请人是否有不良信用记录，申请材料是否真实、齐全、符合要求，申请材料齐全、符合要求的予以审查通过，并报局领导决定。

Decision: the municipal Bureau shall make a decision to approve the administrative license for those meeting the conditions and standards.

决定：局领导对符合条件、标准的，决定机构作出准予行政许可决定。

Preparation and delivery of work permit: from the date of making adecision on work permit, the work permit for foreigners and the decision on approval of administrative license shall be made and issued within two working days.

制证与送达：自许可作出决定之日起，1个工作日内制作好《外国人工作许可证》和准予行政许可决定书，1个工作日内颁发《外国人工作许可证》和准予行政许可决定书。

According to The Exit and Entry Administration Law of the People’s Republic of China Article 41: Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who have no work permits or work-type residence permits.

根据《中华人民共和国出境入境管理法》第四十一条规定：外国人在中国境内工作，应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
