一、德宇浩实业集团有限公司与师国强工伤保险待遇纠纷上诉案

【裁判要旨】

用人单位与劳动者的劳动关系自用工之日起建立,并应缴纳社会保险费用。试用期期间,职工在工作中受到事故伤害,享有获得医疗救助和经济补偿的权利,其应享受的工伤保险待遇由工伤保险基金支付,但公司在某一年度未给职工缴纳工伤保险费的,职工在此年度应享受的工伤保险待遇,由公司自行承担经济补偿责任,并根据《工伤保险条例》规定的工伤保险待遇项目和标准计算具体费用。

[Judgment Abstract] 

The labor relationship between an employer and an employee is established from the date of employment, from which the employer should pay the social insurance premiums for the employee. An employee is entitled to, during the probationary period, obtain medical assistance and economic compensation if he or she suffers from a work-related injury. The compensation will be paid through work-related insurance funds. Nevertheless, once a company fails to pay the premium for a year, the company should be solely liable for making economic compensation for the employee over the due work-related injury insurance benefits he or she is entitled to, with the specific amount determined in accordance with items and standards stipulated in the Regulation on Work-Related Injury Insurance.

【裁判摘要】

劳动者因第三人的侵权行为受到伤害造成工伤的,可以直接向第三人提出侵权损害赔偿,同时申请工伤鉴定,此为受害人的权利,第三人、保险单位和用人单位应当承担赔偿责任。但劳动者因治疗所支出的住院费、医药费等费用,只能获得一次赔偿,即从工伤保险基金中支付的费用不得再要求第三人进行赔偿。对于工伤保险基金不能支付的部分,权利人要求第三人进行赔偿的,应予支持。

[Judgment Abstract]

Where an employee gets hurt because of third-party's infringement, the employee has the right to directly claim compensation from the third party while filing for work-related injury assessment. The third-party, the insurance company, and the employer should assume compensation liability. However, the medical expenses paid by the employee can be only covered for once. That is to say, the employee cannot claim for the compensation from the third-party if it has been covered by work-related injury insurance funds. However, if an employee files a claim demanding the compensation from a third-party with regard to any amount of expenses not covered by work-related injury insurance, the court should support such claim.

三、昆山盛通劳务派遣服务有限公司诉昆山奎冠电子有限公司要求分担派遣员工工伤保险待遇损失纠纷案

【裁判要旨】

根据《中华人民共和国劳动合同法》第九十二条的规定,用工单位给被派遣劳动者造成损害的,劳务派遣单位与用工单位承担连带赔偿责任。但劳务派遣单位与用工单位约定,由劳务派遣单位给劳动者缴纳社保并承担未缴纳所造成的一切后果,上述约定系双方在自愿平等基础上做出的,无违反法律法规的情形,因此,该约定应认定为合法有效。根据约定,因劳务派遣单位未给劳动者缴纳社保,因此,劳动者因工受伤所产生的损失原则上应由劳务派遣单位承担。但是用工单位作为实际用工者和劳动者付出劳务的主要受益者,对被派遣员工依法负有保障其劳动安全的责任,其不能因与劳务派遣单位之间的相关约定,而对派遣员工的劳动安全保障漠视不理。因此,此种情形下,对于劳动者在工作中因工受伤产生的工伤保险待遇损失,劳务派遣单位负有赔偿责任,同时,用工单位应适当分担损害赔偿数额。

[Judgment Abstract]

Under Article 92 of the Labor Contract Law of the People's Republic of China, where any damage is caused to the worker dispatched, the labor dispatch service provider and the accepting entity shall assume joint and several liability for damage. However, if any agreement is signed between the said two entities that the labor dispatch service provider should be responsible for contributing social security premium or otherwise take the corresponding consequences, and the agreement is reached on the basis of voluntariness and equality without contravening relevant laws and regulations, such agreement shall be determined as legal and valid. Accordingly, any loss incurred to the worker dispatched as a result of work-related injury should be in principle borne by the labor dispatch service provider due to its failure to contribute the social security premium for the dispatched worker. Notwithstanding, the labor accepting entity shall not turn a blind eye to the work safety of the dispatched worker, as it is the actual labor user and also the main beneficiary of labor services. In this case, where the worker dispatched suffers from any loss of work-related injury insurance benefits, the labor dispatch service provider should be liable for damage, while the accepting entity should share the damages in an appropriate proportion.
