The principles of openness, fairness, impartiality and good faith shall be followed in a bidding activity. In this specific case, the company involved was not the tenderee of the land use right involved, but it could potentially have a great influence on the auction of the land use right involved. Before the auction of the land use right involved in the case, the company excluded other bidders through the return of land transfer fee stipulated in a contract, which violated the principles of openness and fairness and damaged the national interests. Therefore, the contract shall be determined as invalid.

[Judgment Abstract]
According to the Law on the Contracting of Rural Land, the contracting party shall in principle not withdraw and adjust contracted land. Unless, within the duration of the contract, the household that undertakes the contract shifts to a city that is divided into regions, thereby becoming a non-agricultural household, or under special circumstances such as severe damage to contracted land due to natural disasters, the contracting party may withdraw and adjust the contracted land. The act of withdrawing and redistributing the contracted land without withdrawing and adjusting the contracted land is an illegal contract issue, and therefore, such act is invalid.

Wu Guilian and Yang Shanglin v. Xie Yunzhen, Wu Guoming and Wu Guoning (case regarding dispute over right to use a homestead)
[Judgment Abstract]
The Constitution Law of the People's Republic of China and the Land Management Law of the People's Republic of China stipulate that homesteads are collectively owned by farmers. Farmers have only the right to use the homestead without ownership, and cannot exercise the right of disposal. Homesteads cannot be illegally traded or illegally transferred in other forms. In particular, China implements a classified residence registration management system. Rural residence registration is an indispensable prerequisite for obtaining the right to use homesteads. The urban population cannot obtain rights to use rural land in any form. Therefore, in accordance with Article 52 of the Contract Law of the People's Republic of China that a contract that violates the mandatory provisions of laws and administrative regulations is invalid, members of rural collective organizations have no right to transfer homesteads to personnel with urban residence registration, as such contract for transfer is invalid.
