一、陈凡诉白银市福瑞源绿色农业有限责任公司物权保护纠纷再审案

Chen Fan v. Baiyin Furuiyuan Green Agriculture Co., Ltd. (retrial of case regarding dispute over protection of property right)

【裁判要旨】

双方当事人对国有土地使用权的归属发生争议。一方当事人将国有土地使用权承包给他人,后又转让流转至己处,并有村委会出具的土地流转合同,但因该土地系国有土地非集体土地,前述事实及流转合同不能证明其合法拥有土地使用权。另一方当事人拥有该土地的国有土地使用权证书,依据不动产物权变动的原则,其合法拥有该国有土地使用权。

[Judgment Abstract] 
In this case, two parties had a dispute over the ownership of the right to use state-owned land. The right to use state-owned land was contracted by one party to another before being transferred to himself afterwards, accompanied by a land transfer contract issued by the village committee. However, since the land is state-owned land, and not collective land, the aforementioned facts and the transfer contract cannot prove his legal ownership of the right to use the state-owned land. The other party who has the certificate of the right to use state-owned land legally enjoys the right to use such land in accordance with the principle of change in real estate rights.

【裁判摘要】
在借款保证合同纠纷中,保证人与债务人基于真实的意思表示签订的个人连带保证合同合法有效,保证人应对债务人的债务承担连带保证责任。涉案保证人以个人财产为债务人提供连带保证担保,承担不可撤销的无限连带保证责任,应对债务承担连带清偿责任。

[Judgment Abstract]

In a dispute over a loan guarantee contract, a personal joint guarantee contract signed by a guarantor and a debtor based on true intention of parties is legal and valid. As a result, the guarantor shall bear joint and several guarantee responsibilities for the debtor's debt. The guarantor involved in this case is held joint and severally liable for guarantees to the debtor with personal property, assumes irrevocable unlimited joint and several guarantee obligations, and shall bear joint and several liability for debt settlement.

【裁判要旨】

物权为对世权和绝对权,任何人都不得以任何形式侵犯物权,否则物权人有返还请求权、妨害预防请求权、妨害排除请求权和损害赔偿请求权。依照《物权法》第七条关于“物权的取得和行使,应当遵守法律,尊重社会公德,不得损害公共利益和他人合法权益”、第四条关于“国家、集体、私人的物权和其他权利人的物权受法律保护,任何单位和个人不得侵犯”以及第三十二条关于“物权受到侵害的,权利人可以通过和解、调解、仲裁、诉讼等途径解决”之规定,他人侵犯当事人的物权的,当事人有权起诉以保护其物权不受侵犯。故当事人认为他人与第三人签订的房屋买卖协议侵犯了其房屋所有权的,有权起诉要求确认合同无效。

[Judgment Abstract]
A property right is a form of absolute right, so no one shall infringe a property right in any form. Otherwise, the property right holder enjoys the right to returns, the right of prevention, the right to prevent exclusion and the right to claim damages. As stipulated in the provisions of the Property Law, “In acquiring or exercising a property right, one shall abide by the law, respect social morals and may not damage the public interests or the legitimate rights and interests of any other person” as in Article 7; “The property rights of the state, collective, individuals or any other right holder shall be protected by law and shall not be infringed by any entity or individuals” as in Article 4; and “In case a property right is injured, the right holder may solve the problem through such channels as conciliation, mediation, arbitration, or litigation, among others.” as in Article 32. Where others infringe a party's property rights, the party has the right to file a lawsuit to protect their property rights from being infringed. Therefore, where a party believes that house ownership has been infringed because a house sale agreement was signed by another party and a third party, he has the right to file a lawsuit to confirm the contract as invalid.
