1. 《创新体制机制推进农业绿色发展的意见》出台

近日,农业部发布《创新体制机制推进农业绿色发展的意见》。

《意见》提出,要建立低碳、低耗、循环、高效的加工流通体系。根据《意见》:一是健全完善农产品流通体系;二是加强农产品流通基础设施建设;三是加强市场信息服务功能建设。

1. Opinions Released to Innovate in Systems and Mechanisms for Green Agricultural Development

Recently, the Ministry of Agriculture issued the Opinions on Innovating in Systems and Mechanisms to Promote Green Agricultural Development.

The Opinions requires the establishment of a processing and circulation system featuring low carbon, low consumption,circulation and efficiency. First, the circulation system of agricultural products should be improved. Second, great importance should be attached to the construction of infrastructure for the circulation of agricultural products. Third, market information service functions should be enhanced.

2.《保险公司偿付能力管理规定(征求意见稿)》发布

近日,中国保险监督管理委员会就拟修订的《保险公司偿付能力管理规定(征求意见稿)》公开征求意见。

此次征求意见稿规范了保监会、保监局、保险公司以及中介机构、投资者等市场相关方在偿付能力监管体系中的职责定位,构建起监管机构内部上下联动、监管与市场内外结合、保险公司与监管机构各负其责的偿付能力监管机制和体系。

征求意见稿进一步明确了以风险为导向,建立定量资本要求、定性监管要求和市场约束机制相结合的三支柱偿付能力监管体系;同时还明确,偿付能力达标公司需同时满足“核心偿付能力充足率达50%、综合偿付能力充足率达100%、风险综合评级B类以上”三大指标。《征求意见稿》提出,保监会应当按照国务院金融稳定发展委员会的统一部署,建立健全与人民银行、银监会、证监会、外汇管理局等相关部门间的审慎监管协作机制,强化金融监管协作。

2. Exposure Draft on Solvency Regulation of Insurers Released

The China Insurance Regulatory Commission (CIRC) is requesting public comments on the Provisions on the Administration of the Solvency of Insurance Companies (Exposure Draft) as revised. 

The Exposure Draft specifies the duties of CIRC, local offices of CIRC, insurance companies, intermediaries, investors, and other relevant parties in the solvency supervision system,and aims to establish solvency supervision mechanisms and system featuring vertical interactions of regulators and combination of external regulation and internal regulation of markets where insurance companies and regulators play their respective roles. 

The Exposure Draft further requires the establishment of a risk-based solvency supervision system integrating quantitative capital requirements, qualitative supervision requirements, and market restraints as the three pillars. Companies up to the solvency standards need to satisfy the three major indicators of "core solvency adequacy ratio reaching 50%, comprehensive solvency adequacy reaching 100%, and composite risk rating at or above B ."

3.《国务院办公厅关于完善反洗钱、反恐怖融资、反逃税监管体制机制的意见》正式印发

近日,《国务院办公厅关于完善反洗钱、反恐怖融资、反逃税监管体制机制的意见》正式印发。

《意见》按照问题导向、防控为本、立足国情、依法行政的基本原则,从健全工作机制、完善法律制度、健全预防措施、严惩违法犯罪活动、深化国际合作、创造良好社会氛围六个方面提出二十余项具体措施,目标是到2020年逐步健全适应社会主义市场经济要求、适合中国国情、符合国际标准的“三反”法律法规体系,建立职责清晰、权责对等、配合有力的“三反”监管协调合作机制,有效防控洗钱、恐怖融资和逃税风险。

3. Opinions of the General Office of the State Council on Improving the Regulatory Systems and Mechanisms against Money Laundering, Terrorist Financing, and Tax Evasion Officially Issued

Recently, the Opinions of the General Office of the State Council on Improving the Regulatory Systems and Mechanisms against Money Laundering, Terrorist Financing, and Tax Evasion were officially issued.

Under the fundamental principle of "problem-oriented, focusing on prevention and control, based on national conditions, and governing by law, "the Opinions put forward more than 20 specific measures from six aspects: improving working mechanisms, improving the legal system, improving preventive measures, severely punishing illegal and criminal activities, deepening international cooperation, and creating a good social atmosphere, aiming to gradually improve the systems of the "three-antis" laws and regulations to conform to the requirements of socialist market economy, China’s national conditions, and international standards by 2020 , establish a coordination and collaboration mechanism for the "three-antis" regulation with clear functions, equal powers and responsibilities, and strong cooperation, and effectively prevent and control money laundering, terrorist financing and tax evasion risks.

4.《拍卖监督管理办法》发布

近日,《拍卖监督管理办法》公布,自2017年11月1日起施行。

《办法》规定,拍卖人不得采用财物或者其他手段进行贿赂以争揽业务;不得利用拍卖公告或者其他方法,对拍卖标的作引人误解的虚假宣传;不得捏造、散布虚假事实,损害其他拍卖人的商业信誉;不得以不正当手段侵犯他人的商业秘密;不得拍卖人及其工作人员以竞买人的身份参与自己组织的拍卖活动,或者委托他人代为竞买;不得在自己组织的拍卖活动中拍卖自己的物品或者财产权利;不得雇佣非拍卖师主持拍卖活动;不得其他违反法律法规及规章的行为。同时,《办法》也规定,竞买人之间不得有“相互约定一致压低拍卖应价”等4种恶意串通行为。竞买人与拍卖人之间不得有“私下约定成交价”等3种恶意串通行为。

4. Measures for Regulation of Auctions Released

Recently, the Measures for the Supervision and Administration of Auctions are issued, effective from November 1, 2017.

According to the Measures, auction companies should not compete for business through bribery with money and other property or by other means; should not make any misrepresentation on the subject matter of auction by taking advantage of auction announcements or other means; should not damage the goodwill of other auction companies by fabrication or spreading false facts; should not infringe others' trade secrets by improper means; should not participate as bidders themselves or through their employees in the auctions organized by themselves, nor authorize others to bid on behalf of them; should not auction their own items or property rights in auctions organized by themselves; should not hire persons other than auctioneers to preside over auctions; and should not conduct other activities in violation of laws, regulations and rules. The Measures prohibit bidders from four kinds of malicious collision, such as agreeing together to bid at lower prices. In addition, three kinds of malicious collusion between a bidder and an auction company are banned, such as privately agreeing on the hammer price.

5.《最高人民法院关于贯彻执行〈关于规范公务员辞去公职后从业行为的意见〉的实施意见》发布

近日,《最高人民法院关于贯彻执行〈关于规范公务员辞去公职后从业行为的意见〉的实施意见》发布。

《实施意见》所针对的主体是最高人民法院的行政在编人员。限制的是行政在编人员根据本人意愿提出辞去公职,经批准依法解除最高人民法院工作人员身份,到国有企事业以外的单位就业或自主创业的行为。

《实施意见》共分适用范围、从业限制范围认定、从业限制的审核、从业限制的管理、相关工作要求等五部分。

主要特点体现在以下四个方面。一是坚持从严规范管理,强调简便易行。二是全面落实《意见》规定。三是结合最高人民法院实际,保持与原有从业限制规定的衔接,将《法官法》《律师法》等相关规定予以吸收。四是明确责任主体,强化职责分工。

5. SPC issues Implementation Opinions on Regulating the Occupational Conduct of Former Civil Servants

Recently, the Opinions of the Supreme People’s Court on Implementing the Opinions on Regulating the Occupational Conduct of Civil Servants after Their Resignation from Public Offices were issued. 

The Implementation Opinions involve the administratively permanent staff of the SPC, and restrict their employment with entities other than state enterprises and institutions or their self-employment after their voluntary resignation from public offices and the approval of discharge of them as staff of the SPC in accordance with the law. 

The Implementation Opinions are divided into five parts: the scope of application, determination of the scope of limitation on employment, examination of employment restrictions, management of employment restrictions, and related work requirements.

The Implementation Opinions require: first, adherence to the strict and standardized management and emphasis on convenience and practicability; second, comprehensive implementation of the Opinions; third, combination with the actual circumstances of the SPC, maintenance of connection with existing employment restrictions, and absorption of relevant rules in the Judges Law and the Lawyers Law; and fourth, clarification of persons responsible and enhancement of division of duties.

6.《关于开展律师调解试点工作的意见》出台

最高人民法院、司法部日前联合印发了《关于开展律师调解试点工作的意见》。

《意见》规定了律师调解的四种工作模式:一是在人民法院诉讼服务中心、诉调对接中心或具备条件的人民法庭设立律师调解工作室,配备必要的工作设施和工作场所。

二是在县级公共法律服务中心、乡镇公共法律服务站设立专门的律师调解工作室,由公共法律服务中心(站)指派律师调解员提供公益性调解服。

三是在律师协会设立律师调解中心,在律师协会的指导下,组织律师作为调解员,接受当事人申请或人民法院移送,参与矛盾化解和纠纷调解。

四是鼓励和支持有条件的律师事务所设立调解工作室,可以将接受当事人申请调解作为一项律师业务开展,同时可以承接人民法院、行政机关移送的调解案件。

《意见》规定,律师调解可以受理各类民商事纠纷,包括刑事附带民事纠纷的民事部分,但是婚姻关系、身份关系确认案件以及其他依案件性质不能进行调解的除外。

6. Opinions on the Pilot Program of Lawyer Mediation Released

Recently, the Supreme People’s Court and the Ministry of Justice jointly issued the Opinions on Implementing the Pilot Program of Lawyer Mediation.

 The Opinions sets forth four modes of lawyer mediation: First, lawyer mediation offices will be set up within the litigation service centers, litigation-mediation connection centers, or qualified people’s tribunals of the people’s courts, equipped with necessary working facilities.

 Second, specialized lawyer mediation offices will be set up within the public legal service centers at the county level and public legal service stations of townships and towns, and lawyer mediators are designated by the public legal service centers (stations) to provide pro bono services. 

Third, lawyer mediation centers will be set up within bar associations, and under the guidance of bar associations, lawyers as mediators accept the applications of the parties or the transfer of cases from the people’s courts to conduct conflict and dispute mediation. 

Fourth, mediation offices of law firms with sufficient resources are encouraged and supported, and may accept the mediation applications of the parties as a practice and the mediation cases from the people’s courts and administrative agencies.

According to the Opinions, lawyer mediation may be provided forvarious civil and commercial disputes, including the civil disputes incidental to criminal cases, but excluding cases not subject to mediation such as confirmation of marital and personal relations. 

7.养老机构服务规范征求意见

近日,国家标准《养老机构服务质量基本规范》公开征求意见。

《征求意见稿》提出养老机构提供通信服务,通过电话、网络等不同通信手段,协助老年人联系相关第三方;服务过程中应配备能够提供相应服务的环境和设施设备,环境安全,注意保护老年人隐私。《征求意见稿》要求养老机构宜与有资质的外包服务机构签订协议,并建立监督退出机制;公开服务项目和收费标准;活动场所应布置合理,清洁整齐;所有提供服务的人员应按照法律法规及行业要求持证上岗,并掌握相应的知识和技能。

7. Public Comments Requested on Basic Specifications for Service Quality of Elderly Care Institutions

Public comments are being requested on the national standard (GB) of Service Quality Basic Specification for Senior Care Organization. 

According to the Exposure Draft, elderly care institutions should provide communication services for the elderly to contact relevant parties by telephone, Internet and other communication means. Environmental and facility requirements are set forth for corresponding services to ensure safe environment and protection of privacy of the elderly during the service process. The Exposure Draft requires senior care providers to enter into agreements with eligible outsourcing service providers and establish oversight and exit mechanisms; publish their service items and fee rates; and reasonably design and arrange activity places to ensure cleanness and tidiness. In addition, all their service staff should hold qualification certificates as required by laws, regulations, and the industry, and have corresponding knowledge and skills. 

8.《关于开展刑事案件律师辩护全覆盖试点工作的办法》出台

最高人民法院、司法部日前联合出台了《关于开展刑事案件律师辩护全覆盖试点工作的办法》。

《办法》将通知辩护范围扩大到法院阶段适用普通程序审理的所有一审案件、二审案件和按照审判监督程序审理的案件;同时,适用简易程序、速裁程序审理的案件,被告人没有辩护人的,人民法院应当通知法律援助机构派驻的值班律师为其提供法律帮助。

此外,《办法》明确规定二审人民法院发现一审人民法院未履行通知辩护职责,导致被告人在审判期间未获得律师辩护的,应当裁定撤销原判,发回原审人民法院重新审判。

律师刑事辩护全覆盖工作在北京、上海、浙江、安徽、河南、广东、四川、陕西8个省(直辖市)试点,试点期限为一年。

8. Measures Released for Launching a Pilot Program of Full Coverage of Defense Lawyers in Criminal Cases

Recently, the Supreme People's Court (SPC) and the Ministry of Justice (MOJ) jointly issued the Measures for Launching a Pilot Program of Full Coverage of Defense Lawyers in Criminal Cases. 

The Measures expand the applicable scope of a court’s notification of a legal aid agency of appointment of a defense lawyer to all the cases being tried in formal procedures before courts of first instance and appellate courts as well as cases being tried under the trial supervision procedures. In addition, in a case being tried in summary procedures or fast-track procedures where there is no defender appointed for the defendant, the people's court should notify a lawyer on duty sent by a legal aid agency of providing legal assistance to the defendant. 

According to the Measures, if the appellate court discovers that the court of first instance fails to perform its duty of notifying a legal aid agency of appointment of a defense lawyer, resulting in the defendant's failure to obtain defense by a lawyer during the trial, it should rule to quash the original judgment and remand the case to the original trial court for a new trial.

 The Pilot Program of full coverage of criminal defense lawyers will be implemented in eight provinces (municipalities): Beijing, Shanghai, Zhejiang, Anhui, Henan, Guangdong, Sichuan, and Shaanxi, for a term of one year. 

9. 国家工商总局印发支持雄安新区规划建设意见

近日,国家工商总局印发《国家工商行政管理总局关于支持河北雄安新区规划建设的若干意见》。

《意见》表示,依法将“雄安”字样在企业名称核准中予以特殊保护。住所在雄安新区的企业可以冠以“河北雄安”字样。

国家工商总局表示,支持雄安新区优化企业经营登记范围方式,支持雄安新区推行“证照分离”改革试点,对《国民经济行业分类》中没有规范的新兴行业或者具体经营项目,可以参照政策文件、行业习惯、专业文献等提出申请。

9. State Administration for Industry and Commerce Issues Opinions to Support the Planning and Construction of Xiongan New Area

Recently, the State Administration for Industry and Commerce (SAIC) issued the Several Opinions on Supporting the Planning and Construction of Xiongan New Area. 

According to the Opinions, the word "Xiongan" should be given special protection in the approval of enterprise names in accordance with the law. Enterprises domiciled in Xiongan New Area may register their names containing the words "Hebei Xiongan."

SAIC supports Xiongan New Area in optimizing the scopes and manners of registration of enterprises and promoting the pilot program of "separation of permits from business license."For emerging industries and specific business not regulated in the Classification of Industries in National Economy, applications may be filed by referring to policy documents, trade practices, and specialized literature.

10.《拖欠农民工工资“黑名单”管理暂行办法》出台

人社部日前印发《拖欠农民工工资“黑名单”管理暂行办法》。

暂行办法规定,将拖欠工资“黑名单”信息纳入当地和全国信用信息共享平台,由相关部门在各自职责范围内依法依规实施联合惩戒,在政府资金支持、政府采购、招投标、生产许可等方面予以限制。

对于克扣、无故拖欠农民工工资报酬,数额达到认定拒不支付劳动报酬罪数额标准的;或因拖欠农民工工资违法行为引发群体性事件、极端事件造成严重不良社会影响的用人单位,将被列入拖欠工资“黑名单”。

将劳务违法分包、转包给不具备用工主体资格的组织和个人造成拖欠农民工工资且符合前款规定情形的,应将违法分包、转包单位及不具备用工主体资格的组织和个人一并列入拖欠工资“黑名单”。

10. Interim Measures Released on "Blacklists" for Delaying Payment of Wages to Rural Migrant Workers

The Supreme People's Court (SPC) is requesting public comments on the Interpretation (IV) of Several Issues on the Application of the Insurance 

Recently, the Ministry of Human Resources and Social Security issued the Interim Measures for the Administration of "Blacklists" for Delaying Payment of Wages to Rural Migrant Workers.

According to the Measures, the "blacklists" for delaying payment of wages should be included in the local and national credit information sharing platforms, and those on the blacklists should be punished jointly by relevant departments within their respective functions and be restricted in terms of government funding support, government procurement, bidding, and production licensing, among others.

Employers which underpay or delay payment without good reason to rural migrant workers to the extent of being suspected of the crime of refusal to pay labor remuneration or whose illegal delay in payment of wages to rural migrant workers has triggered crowed events or extreme events having grave adverse social effects should be included in the "blacklists".

 Where labor services are subcontracted or assigned to an organization or individual ineligible for employment of workers, causing delay in payment of wages to rural migrant workers, if there are any circumstances as specified in the preceding paragraph, the subcontracting employer, assignor, and ineligible organization and individual should be all included in the "blacklists".

11. 全国律协明确律师办理刑事案件规范

中华全国律师协会日前出台《律师办理刑事案件规范》,对律师参与刑事诉讼活动作出明确规定。

规范明确,律师参与刑事诉讼依法履行辩护与代理职责,人身权利和执业权利不受侵犯。律师参与刑事诉讼在法庭上发表的辩护、代理意见不受法律追究,但发表危害国家安全、恶意诽谤他人、严重扰乱法庭秩序的言论除外。规范还制定了9项权利救济条文,保护律师正常执业权利。

11. National Bar Association Specifies Rules on the Handling of Criminal Cases by Lawyers

The All China Lawyers Association recently issued the Rules on the Handling of Criminal Cases by Lawyers, providing in detail for lawyers’ participation in criminal proceedings.

The Rules reiterate that lawyers should perform their duties of defense and representation in criminal proceedings in accordance with the law and their personal and practicing rights shouldn’t be violated. Lawyers should not be held legally liable for their defense or representation opinions presented in court in criminal proceedings, except for speeches compromising the national security, maliciously defaming others or seriously disrupting the court order. The Rules also contain nine clauses on infringement remedies to protect a lawyer's normal practice of law.

12. 失业保险金标准将逐步提高

人社部、财政部近日共同印发了《关于调整失业保险金标准的指导意见》。

《失业保险条例》规定,失业保险金的标准,按照低于当地最低工资标准、高于城市居民最低生活保障标准的水平,由省、自治区、直辖市人民政府确定。《意见》要求提高失业保险金标准应以《失业保险条例》相关规定为依据,兼顾失业保险“保生活”和“促就业”两项基本功能,在确保基金运行安全前提下,各地应适当上调失业保险金标准,逐步提高到最低工资标准的90%。

12. Unemployment Insurance Benefits to Be Gradually Raised

Recently, the Ministry of Human Resources and Social Security and the Ministry of Finance jointly issued the Guiding Opinions on Adjusting the Standard of Unemployment Insurance Benefits.

According to the Regulation on Unemployment Insurance, the standard of unemployment insurance benefits should be set by the people's government of a province, autonomous region, or municipality at a level lower than the local minimum wage standard but higher than the minimum subsistence standard for urban residents. The Guiding Opinions require that the unemployment insurance benefits should be raised in accordance with the Regulation on Unemployment Insurance and by taking into account the two basic functions of unemployment insurance: "living security" and "employment promotion."Conditioned upon enduring the safe operation of funds of the insurance, local governments should appropriately raise the standard of unemployment insurance benefits, which will gradually reach 90% of the minimum wage.
