1. 中国人民银行发布条码支付规范

人民银行近日发布《中国人民银行关于印发<条码支付业务规范(试行)>的通知》,配套印发了《条码支付安全技术规范(试行)》和《条码支付受理终端技术规范(试行)》,自2018年4月1日起实施。

在业务规范方面,银行业金融机构、非银行支付机构开展条码支付业务涉及跨行交易时,必须通过人民银行清算系统或者合法清算机构处理,支付机构还应符合相应的业务资质要求。为消费者提供条码支付付款服务的,应当立足于小额、便民市场定位,按照风险防范能力等级,对条码支付额度进行分级管理,在风险防范和支付便捷中取得有效平衡。为特约商户提供条码支付收单服务的,应执行银行卡收单业务管理相关要求,切实履行商户管理、交易风险监测等收单主体责任,强化对收单外包机构管理。

1. PBC Issues Rules on Barcode Payment

The People’s Bank of China (PBC) recently issued the Notice of the People’s Bank of China on Issuing the Barcode Payment Business Specifications, as well as the Technical Specifications for the Security of Barcode Payment (for trial implementation) and the Technical Specifications for the Acceptance Terminals of Barcode Payment (for trial implementation), effective from April 1, 2018.

According to the business specifications, barcode payments involving two or more banks provided by banking financial institutions and non-bank payment institutions must be processed through the clearing system of the PBC or legitimate clearing institutions, and payment institutions should also comply with corresponding business qualification requirements. Those offering barcode payment services for consumers should adhere to the market orientation of petty amounts and convenience for the people, and implement graded management of the quota of barcode payment based on the levels of risk prevention capability to achieve an effective balance between risk prevention and payment convenience. Those offering barcode payment acquiring services for merchants should follow the relevant requirements on the management of bankcard acquiring business, fully perform their responsibilities for merchant management and transaction risk monitoring, among others, and reinforce the management of outsourced acquiring service providers.

2. 十二届全国人大常委会第三十一次会议在京闭幕   

十二届全国人大常委会第三十一次会议近日举行闭幕会。

会议经表决,通过了新修订的农民专业合作社法、烟叶税法、船舶吨税法,通过了关于修改招标投标法、计量法的决定,国家主席习近平分别签署第83、84、85、86号主席令予以公布。

会议表决决定将中华人民共和国监察法草案提请十三届全国人大一次会议审议。会议表决通过了关于批准《内地与香港特别行政区关于在广深港高铁西九龙站设立口岸实施“一地两 41 36282 41 14988 0 0 2115 0 0:00:17 0:00:07 0:00:10 3045检”的合作安排》的决定,通过了关于在北京市大兴区等232个试点县(市、区)、天津市蓟州区等59个试点县(市、区)行政区域分别暂时调整实施有关法律规定期限的决定。

2. Thirty-first Session of the Standing Committee of the Twelfth National People's Congress Concluded in Beijing 

The Thirty-first Session of the Standing Committee of the Twelfth National People's Congress recently held its closing meeting.

After voting, the newly revised Law on Specialized Farmers' Cooperatives, Tobacco Leaf Tax Law, and Vessel Tonnage Tax Law were passed, as well as the decision to amend the Bidding Law and Metrology Law, and were issued by Presidential Order 83, 84, 85, and 86.

At the meeting, it was also decided to submit the draft Supervision Law of the People's Republic of China to the First Session of the Thirteen National People’s Congress for deliberation. The decision to approve the Cooperative Arrangements between the Mainland and the Hong Kong Special Administrative Region on the Implementation of "One place, Two Checks" at the Port at the West Kowloon Station of Guangzhou-Shenzhen-Hong Kong High Speed Railway and the decision on the period of temporary adjustment of implementation of relevant laws and regulations in the administrative regions of 232 pilot counties (cities, districts) including Daxing District, Beijing and 59 pilot counties (cities, districts) including Jizhou District, Tianjin were also adopted at the meeting.

3. 全国人大常委会办公厅印发两个立法工作规范

近日,全国人大常委会办公厅印发《关于立法中涉及的重大利益调整论证咨询的工作规范》和《关于争议较大的重要立法事项引入第三方评估的工作规范》。

两个工作规范对“重大利益调整论证咨询”、“第三方评估”等一些重大概念进行了界定,明确了开展重大利益调整论证咨询和第三方评估工作的立法工作环节,明确了开展论证咨询、第三方评估应当采取的方式方法以及程序等,同时具体规定了如何运用论证咨询工作和第三方评估所取得的成果。

3. General Office of the NPC Standing Committee Issues Two Sets of Rules for Legislative Work

Recently, the General Office of the Standing Committee of the National People’s Congress (NPC) issued the Working Rules for the Discussions and Consultations over Major Interest Adjustments Involved in Legislation and the Working Rules for Introducing the Third Party Assessment of Important Legislative Affairs in Significant Controversy. 

These rules define the major concepts such as “discussions and consultations over major interest adjustments” and “third party assessment,” specify the legislative stages and the methods and procedures for implementing discussions and consultations over major interest adjustments and third party assessment, and provide in detail for how to use the results of discussions and consultations and the third party assessment.

4. 《人民检察院案件质量评查工作规定(试行)》发布

最高人民检察院日前印发《人民检察院案件质量评查工作规定(试行)》,对案件质量评查工作的定义、基本要求、评查方式、评查程序与结果运用等作出规定。

《规定》要求,案件质量评查应当坚持统一组织与分工负责相结合,问题导向与正向激励相结合,监督管理与服务司法办案相结合,人工评查与智能辅助相结合,主观过错与客观行为相一致。

《规定》对评查内容、结果等次和评查程序、异议机制等作了规范,要求着重从证据采信、事实认定、法律适用、办案程序、文书制作和使用、释法说理、办案效果、落实司法责任制等方面进行评查,并提出了评查的基本标准和评查结果等次。

4. SPP Issues Provisions on Case Quality Review

Recently, the Supreme People’s Procuratorate (SPP) issued the Provisions on the Case Quality Review of the People’s Procuratorates (for Trial Implementation), providing for the definition of case quality review, basic requirements, review methods and procedures, and application of review results, among others.

According to the Provisions, the case quality review should adhere to the combination of unified organization with division of labor, problem orientation with positive incentives, supervision and management with case handling services, and manual review with intelligent assistance and the consistence between subjective faults and objective acts.

The Provisions regulate the content and result rating of review, the review procedures, and the opposition mechanism, require the review to be conducted particularly in terms of evidence admissibility, fact finding, application of law, case handling procedures, production and use of documents, interpretation of law and reasoning, case handling effects, and implementation of the judicial responsibility system.

5. 最高法发布仲裁司法审查案件两个司法解释

近日,《最高人民法院关于仲裁司法审查案件报核问题的有关规定》和《最高人民法院关于审理仲裁司法审查案件若干问题的规定》发布,均于2018年1月1日起施行。

两个司法解释明确,仲裁司法审查案件包括:申请确认仲裁协议效力案件;申请执行或撤销我国内地仲裁机构的仲裁裁决案件;申请认可和执行香港特别行政区、澳门特别行政区、台湾地区仲裁裁决案件;申请承认和执行外国仲裁裁决案件。

审理司法解释明确,人民法院在仲裁司法审查案件中作出的裁定,除不予受理、驳回申请、管辖权异议的裁定外,一经送达即发生法律效力。当事人申请复议、提出上诉或者申请再审的,人民法院不予受理,但法律和司法解释另有规定的除外。

5. SPC Issues Interpretations on Arbitration-Related Judicial Review Cases 

Recently, the Provisions of the Supreme People’s Court on Issues concerning the Reporting for Verification of Arbitration-Related Judicial Review Cases and the Provisions of the Supreme People’s Court on Several Issues concerning the Trial of Arbitration-Related Judicial Review Cases were issued, both effective from January 1, 2018.

According to the two judicial interpretations, arbitration-related judicial review cases cover the applications for determination of the validity of arbitration agreements, the applications for the enforcement or revocation of arbitration awards rendered by mainland arbitral institutions, the applications for the recognition and enforcement of arbitration awards rendered in the Hong Kong Special Administrative Region, Macao Special Administrative Region, or Taiwan region, and the applications for the recognition and enforcement of foreign arbitral awards.

According to the judicial interpretation on the trial of such cases, a ruling issued by a people's court for an arbitration-related judicial review case becomes legally binding upon service, except for application rejection and dismissal and jurisdictional challenge rulings. An application for reconsideration, an appeal, or a petition for retrial filed by a party against the ruling should not be accepted by the people’s court, unless otherwise provided for by laws and judicial interpretations.

6. 《关于推进重大建设项目批准和实施领域政府信息公开的意见》发布

近日,国务院办公厅印发《关于推进重大建设项目批准和实施领域政府信息公开的意见》。

《意见》明确,在重大建设项目批准和实施过程中,重点公开批准服务信息、批准结果信息、招标投标信息、征收土地信息、重大设计变更信息、施工有关信息、质量安全监督信息、竣工有关信息等8类信息。批准服务信息、批准结果信息由批准重大建设项目和有关要件的各级政府和有关部门分别负责公开,招标投标信息由招标人或有关行政监督部门依法公开,征收土地信息由辖区政府和有关部门负责公开,重大设计变更信息由批准单位负责公开,施工有关信息、质量安全监督信息、竣工有关信息由制作或保存的部门按照职责分工分别负责公开。

6. Opinions Issued on Promoting Open Government Information on the Approval and Implementation of Major Construction Projects 

Recently, the General Office of the State Council issued the Opinions on Promoting Open Government Information on the Approval and Implementation of Major Construction Projects.

According to the Opinions, emphasis should be placed on the public disclosure of eight kinds of information, including approval service information, approval result information, bidding information, land expropriation information, major design modification information, relevant construction information, quality and safety supervision information, and relevant construction completion information, in the approval and implementation process of major construction projects. The approval service and approval result information should be published respectively by the people’s governments and relevant departments that approve major construction projects and relevant essential elements, the bidding information should be published by the bidders or relevant administrative regulators in accordance with the law, the land expropriation information should be published by the government and relevant departments having jurisdiction, the major design modification information should be published by the approving entities, and the related construction information, quality and safety supervision information, and construction completion information should be published respectively by the departments producing or preserving such information according to the division of duties.
